paint.net being sold illegally

Hello, I am a game developer whos games have been being sold illegally. On the seller's 'product page' I noticed that paint.net was being sold under the name of 'creative paint'. I personally love paint.net and use it all the time and feel anger towards this person, and am going around to all his victims informing them, hoping that SOMEONE has the recourses to end this.

If you scroll down, you will see Paint.NET being sold for $50 under the name of 'creative paint'. Along the way, you will see many open source projects and other scams.

Please stop him, I unfortunately never thought of copyrighting my game, and now have no legal ability to my knowledge to bring him down, nor the money to do so...

I finally sent the loser an e-mail and he has taken the site down. Again.

We'll see how long until he puts it back up again ...

By the way, looks like he had hopped from .com to .net since the first post in this thread (http://hardycreations.net in other words). No doubt his "old" host got wind of his plagiarism and dumped him.

I had never threatened actual legal action before, but I decided now was the time for it.

"Creative Paint" is a plagiarized version of Paint.NET, http://www.getpaint.net/ . You are claiming to be its author, and have released it under a new license. This is not permitted by the Paint.NET license, and therefore you are breaking the law. "Creative Paint" includes effect plugins which are being distributed without their authors' permissions, which is in violation of United States copyright law. The plugins' original place of publication is on the Paint.NET forum, http://forums.getpai...ublishing-only/ , where it is clearly stated that redistribution is not allowed unless you have permission from the author.

You are also plagiarizing content from the Paint.NET website, http://www.getpaint.net/, which is not permitted -- the website's contents are covered by a Creative Commons Attribution-Noncommercial license. You are not providing attribution, and since you are attempting to sell "Creative Paint" for $50, which is a commercial endeavor, you are not permitted to use the content in any way.

You must immediately discontinue the "Creative Paint" product and take down the website.

Michael, you've been repeating this offense for the last several years and I'm sick of it, as are many of the plugin authors you've been plagiarizing. If you continue with this, then I will bring legal action against you.

I am also sending a copy of this e-mail to your hosting provider. I don't think they will appreciate you using their servers for this.

I'm just curious, before v3.5, why did you release PDN under the MIT license? I mean, it was pretty cool, but seriously, the right to sell the software without restriction? Wouldn't a custom EULA have been a better idea?

Paint.NET does seem to be missing from the website now.

This scumbag is back.  He's got a new version (as of this past May) uploaded on a dedicated site (creative hyphen paint dot com).  Installed it on a VM and not only does he claim it's his, the about file claims that he "had the idea for it" years ago.  If I type what I really think about him I'd have to give myself a warning.

 

He's not charging for it, but he is asking for donations and still packaging stolen plugins from the forum.

And then the guy has the nerve to say his family supported him during the development. What development!? A copy and paste project?
